Over the past 50 years, Mr. Macdonald has developed a broad range of insurance and reinsurance experience as an underwriter, intermediary, and reinsurer. Since he became a full-time consultant in 2006, he has completed over sixty engagements for clients including insurers, reinsurers, investors, and both state and federal agencies. The transactions assessed include both the acceptability of claims and underwriting practices. Mr. Macdonald has also published over thirty articles and research reports on specialty insurance issues for authorities such as the International Risk Management Institute (IRMI), Business Insurance, Conning & Company, and the Rand Corporation. The following are examples of the central issues addressed in recent engagements:
- Whether a "micro-captive" Insurers claims and underwriting practices complied with acceptable industry practices regarding the four prongs of US Tax Courts (regarding "insurance risk", risk transfer, risk distribution, and insurance as it is commonly understood).
- Whether the "sweep" provision in expired Bermuda Liability Excess policies should be required to pay certain later reported claims.
- Whether an excess liability insurer should be allowed to exclude claims from a class action related to a medical product based on a failure of the policyholder to provide sufficient information;
- Whether the various parties involved in "fronting" arrangements performed their respective duties in a manner that should prevent a reinsurer from denying losses.
